Welcome to Fitness and Recovery Suite ("Company," "we," "us," or "our"), operated by Prestinum Group LLC, a Wyoming limited liability company. These Terms of Service ("Terms") govern your access to and use of our website at www.fitnessandrecoverysuite.com and any related services (collectively, the "Services"), including browsing, purchasing, and interacting with our store.

Fitness and Recovery Suite is powered by Shopify, which enables us to provide the Services to you.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.

We have made every effort to accurately represent our products, but colors, finishes, and dimensions may appear differently depending on your device and screen settings. Product descriptions, specifications, and availability are subject to change at any time without notice.

We reserve the right to limit quantities, discontinue products, or restrict sales to certain regions, and lead times may vary by product.

Orders, Pricing & Payment

Placing an order is an offer to purchase; your order is not accepted until we confirm it, which typically happens once payment has been received and processed. We reserve the right to refuse or cancel any order, including for suspected fraud, pricing or listing errors, or product unavailability. If we cancel or modify your order, we'll attempt to notify you using the contact information provided at checkout.

Prices, discounts, and promotions are subject to change without notice; the price charged will be the price in effect at the time your order is placed, as shown in your order confirmation. Posted prices do not include taxes, shipping, customs, or import charges unless stated otherwise.

Payments are processed securely through Shopify Payments. You represent that any payment information you provide is accurate and that you are authorized to use the payment method provided.

Because our products are high-ticket items, some orders may require additional verification before processing.

Shipping & Delivery

Please refer to our Shipping Policy for details on shipping timelines, freight carriers, and delivery requirements for large equipment.

All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, manufacturing lead times, or other events outside our control. Once we transfer a product to the carrier, title and risk of loss pass to you, though we'll help coordinate freight claims for items damaged in transit — see our Return & Refund Policy for details.

Returns & Refunds

Returns, exchanges, and refunds are handled in accordance with our Return & Refund Policy. You represent that your purchases are for personal or household use and not for commercial resale.

Product Safety & Installation

Many of our products — including saunas, cold plunges, hyperbaric chambers, and other recovery and wellness equipment — involve electrical, water, heat, or pressure components. You are responsible for:

  • Following the manufacturer's installation, safety, and operating instructions provided with your product.
  • Arranging licensed or professional installation where required by the manufacturer or by local electrical, plumbing, or building codes.
  • Consulting a qualified physician before using any recovery equipment if you have a pre-existing health condition.

We are not liable for injury, property damage, or product failure resulting from improper installation, modification, or use that does not follow the manufacturer's instructions. Manufacturer warranties, where available, are provided by the product manufacturer, not by us; we'll assist in facilitating warranty claims where possible.

Intellectual Property

All content on our Services — including text, graphics, logos, product images, and software — is owned by Fitness and Recovery Suite, its affiliates, or its licensors, and is protected by applicable intellectual property laws. Shopify's name, logo, and related marks are trademarks of Shopify.

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Services without our prior written consent.

The Services may give you access to tools or content provided by third parties that we do not control or monitor. We provide access to such tools "as is" and "as available," without warranty, and we have no liability for your use of them.

The Services may also contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site, and accessing them is at your own risk.

User Content & Feedback

If you submit reviews, comments, or other content ("User Content") to the Services, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display that content in connection with operating and promoting the Services.

You agree not to submit User Content that is unlawful, harmful, threatening, defamatory, obscene, or that infringes on another party's rights.

If you send us feedback, suggestions, or ideas, you grant us a perpetual, royalty-free, worldwide license to use them for any purpose, including commercial use, without compensation or obligation to you.

Relationship with Shopify

Fitness and Recovery Suite is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Fitness and Recovery Suite, not Shopify. Shopify is not responsible for any aspect of the sales between you and us, including any injury, damage, or loss resulting from purchased products. You release Shopify and its affiliates from all claims and liabilities arising from your purchases and transactions with us.

Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy, and certain information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you've read these policies.

Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Product-specific warranties, where offered, are provided by the manufacturer, not by us. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above limitations may not apply to you.

Limitation of Liability & Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, FITNESS AND RECOVERY SUITE, PRESTINUM GROUP LLC, AND OUR RESPECTIVE OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, INCLUDING LOST PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Fitness and Recovery Suite, Prestinum Group LLC, Shopify, and our respective affiliates, officers, and employees from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

Dispute Resolution & Governing Law

Before filing a claim, you agree to contact us at support@fitnessandrecoverysuite.com so we can try to resolve the dispute informally. If we can't resolve it within 30 days, any dispute arising from these Terms or your use of the Services will be resolved through binding arbitration administered by the American Arbitration Association (AAA), on an individual basis rather than as part of a class action, except where prohibited by applicable law.

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, and, where arbitration does not apply, you and Fitness and Recovery Suite consent to the exclusive jurisdiction of the courts located in Wyoming.

Flag for review: arbitration and class-action-waiver clauses are heavily regulated — and unenforceable in some places, including parts of Canada — so have this section reviewed by a lawyer licensed in the regions you sell into before publishing.

General Provisions & Changes to These Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a right or provision will not be considered a waiver of that right. These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and us regarding the Services.

You may not assign these Terms without our written consent; we may assign them without notice. Section headings are for convenience only and do not affect interpretation.

We may update these Terms at any time by posting the revised version to our website. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
